Use of Content

By using J. J. Keller's Training on Demand (TOD), you affirm that you have read and agree to be bound by the terms and conditions of the Use of Content Guidelines, and of this License. In the event of a conflict between the Guidelines and the License, wording of the License shall prevail.

J. J. Keller reserves the right to make changes in the terms and conditions of this License. Such changes will be incorporated in the License and posted here. You acknowledge that TOD is compiled, prepared, selected and arranged by J. J. Keller through the expenditure of substantial time, effort and money and that it constitutes valuable property of J. J. Keller. You acknowledge and agree that all proprietary rights in TOD shall remain property of J. J. Keller or its third party providers and you do not acquire rights therein except as specifically provided in this License agreement.

Intent
The purpose of many of our online training courses and video-based training is to provide students with a general overview of the subject matter and is usually aimed at helping you (the party responsible for training, the trainer) and your trainees (the student, or the parties requiring training) comply with government training requirements. J. J. Keller's courses are intended to supplement your training. Ensuring that trainees meet training requirements is ultimately your responsibility. It is up to the trainer to provide hands-on training (function-specific), company or site-specific information, and additional testing. It is a trainee's responsibility to check their company's policy regarding site-specific or hands-on training. Any questions, misunderstandings, or conflicts that trainees may have with the employer's rules should be directed to the employer. Although many of J. J. Keller's online training courses and video-based training programs are designed to meet federal regulations, it is the trainee's and the trainer's responsibility to make sure that they are meeting state and local regulations.

Certificate of Completion
A Certificate of Completion from J. J. Keller indicates the trainee has completed the requirements of an online course, which may include passing exams and spending the requisite amount of time in the course. A certificate from J. J. Keller does not guarantee that a trainee possesses a minimum level of skills or knowledge regarding the subject matter. It is the trainer's responsibility to assess the trainee's level of skill or knowledge and determine whether the trainee is qualified to perform a specific job or function.

Honor Code
J. J. Keller trusts in the integrity of the trainee to observe the honor code. The honor code is based on the assumption that the trainee will be honest when taking an exam. The trainee agrees that only he or she will take the exams and complete required exercises and that he or she will not distribute or share exam questions or provide answers to other trainee enrolled in the course.

Passwords
Trainers and trainees may not disclose or share their password with others, and will notify J. J. Keller if he or she believes that someone has learned their passwords.

Use of Training On Demand Content
Whether copyrighted or not, all use of all content found in the Training On Demand site is governed by the terms of the User Agreement. Your rights and obligations concerning particular content can be found below in Use of Content Guidelines, which is part of the User Agreement.

Use of Content Guidelines

  1. Personal Use Only
    Training on Demand content is intended for your personal professional use and for the use of your registered online training students who are your direct reports.

  2. Internal Use Only
    Training on Demand content (including Video On Demand content) is for internal use within your company. You may not, and may not permit others, to use the content to perform training, prepare work, documents or reports, etc., for any party outside of your organization.

  3. Online Training
    You may purchase and use Training Points for the trainees of your company only; this includes contractor or for hire personnel. Training Points cannot be resold. User names and passwords cannot be shared. Training Points expire after one year. There will be no refund for unused Training Points.

  4. Remote Viewing - Video On Demand Training
    Remote Viewing functionality in Video On Demand is intended for your personal professional use and for the use of your trainees who are your direct reports.

  5. Copyright Notices
    Copyright notices appearing in the Training On Demand site content - video, text and images - are to be retained.

Report Unauthorized Use or Copying
Unauthorized copying of software and internet content is theft. J. J. Keller supports and participates in the Software and Information Industry Association's anti-piracy program. You can learn more about this program at www.siia.net and use the SIIA site to report pirated content and software.

J. J. Keller & Associates, Inc., has taken steps to be compliant with the "safe harbor" provisions of the Digital Millennium Copyright Act (DMCA).


Remote Computer Access
With your permission, a member of our support team will use our live remote-assistance tool (GoToAssist™), to view your desktop and control of your mouse and keyboard to help resolve your technical issue.  Once the session is closed, the GoToAssist™ access cookie is removed and we no longer have access to your computer.
